After I Do — Terms of Service
Last updated: [DATE — set on launch day]
1. Acceptance of these Terms
These Terms of Service (“Terms”) are a binding agreement between you and [LEGAL ENTITY NAME], operating the website at afterido.co and the marketplace known as “After I Do” (“After I Do,” “we,” “us”). By creating an account, listing an item, booking an item, or otherwise using the platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the platform.
You must be at least 18 years old and able to form a binding contract to use After I Do.
2. What After I Do is — and is not
After I Do is an online venue that connects people who own wedding decor (“Lenders”) with people who wish to rent or buy that decor (“Renters” and “Buyers,” together “Users”). We provide listing tools, a booking calendar, payment processing through our third-party processor, and a standard set of transaction documents.
After I Do does not own, possess, inspect, store, ship, or handle any item listed on the platform. Every rental or sale is a transaction directly between a Lender and a Renter or Buyer. After I Do is not a party to that transaction, is not the seller or lessor of any item, and makes no representation or warranty about any item, any User, or any transaction except as expressly stated in these Terms.
3. Accounts
You are responsible for your account, for keeping your login secure, and for everything done under your account. You agree your listing and profile information is accurate and current. We may suspend or terminate accounts that violate these Terms.
4. Listings (Lender obligations)
Lenders agree that for every listing:
- They own the item or have the right to rent or sell it.
- Photographs are true, current, and unedited representations of the actual item, taken from multiple angles, and accurately show its condition.
- The written description, rental rate, availability calendar, and condition rating are accurate.
- The item is clean, functional, and as described before it ships.
After I Do reviews listings before they go live but does not verify the accuracy of any listing and is not responsible for listing content.
5. Bookings, payments, and commission
Renters book by selecting available dates and submitting a request. The Lender has up to six (6) days to accept or decline. On acceptance, payment is collected and held by our payment processor until the transaction completes.
Rentals have a minimum of three (3) and a maximum of fourteen (14) days.
After I Do charges a commission of ten percent (10%) of each completed transaction. Lender payouts equal the transaction price minus the commission and minus any late fees or amounts owed under these Terms. Payouts release after confirmed return delivery with no open damage claim, and after a 7-day completion threshold, subject to a minimum withdrawal of $20. All payments are processed by [STRIPE / PAYMENT PROCESSOR]; your use of payments is also subject to the processor’s terms.
6. Sales of decor
Some items are listed for outright sale rather than rental. Sales are final transactions between Lender and Buyer. Items are sold as-is, used, and as represented in the listing photographs and description. Sections of these Terms concerning condition, the platform’s non-party role, claims, and liability apply to sales as well as rentals.
7. Security deposits
7.1 Rentals require a security deposit equal to 25% of the listing’s daily rental rate, per rental day. Example: a $40/day item rented for three days carries a $30 deposit.
7.2 At launch, deposits are collected and held by After I Do via [DEPOSIT METHOD]. (See Attorney Brief §2 — confirm method.)
7.3 The deposit secures the Renter’s obligations, including return of the item in its pre-rental condition. If no claim is made, the deposit is returned per Section 8.
7.4 If damage exceeds the deposit (Level 4, Section 9), the Renter remains liable for the replacement cost beyond the deposit amount.
8. Condition acknowledgement
Renters and Buyers acknowledge that items on After I Do are previously used wedding decor, not new retail goods. The listing photographs and description are the agreed representation of the item’s condition. By booking or buying, you accept the item in the condition shown, subject only to the documentation and claim process in Section 9. After I Do does not guarantee the condition, fitness, or suitability of any item.
9. Documentation and damage
9.1 Documentation. The Lender photographs items before shipment. The Renter photographs all items within 24 hours of delivery and submits the photos through the platform. These timestamped records are the evidentiary basis for any claim.
9.2 Filing. A Renter alleging items arrived damaged or misrepresented must file within 24 hours of delivery. A Lender alleging return damage must file within 48 hours of return delivery.
9.3 Damage levels and the deposit.
- Level 1 — Minor wear: scuffs and marks consistent with careful use. No deposit action.
- Level 2 — Moderate: visible damage not affecting structural integrity. 25–50% deposit forfeiture.
- Level 3 — Significant: item rendered unusable or significantly diminished. 50–100% forfeiture.
- Level 4 — Total loss: item destroyed, lost, or unsalvageable. Full forfeiture plus liability for replacement cost beyond the deposit.
9.4 Process. After I Do administers claims against this published schedule using the timestamped documentation in Section 9.1. (See Attorney Brief §1 — this clause and the “sole arbitrator / decision final” language are the highest-risk items and must be rewritten to the attorney’s guidance before publication.)
10. Returns and late fees
The standard return window is 72 hours after the final rental date. Returns use the prepaid return label provided with the shipment. A Renter who needs more time may purchase the Honeymoon Premium — extended return days at 50% of the daily rate — where the Lender offers it.
If an item is not shipped back within the return window, late fees accrue at the daily rental rate until confirmed return delivery [SUBJECT TO A CAP — see Attorney Brief §4].
11. Cancellations and refunds
[CANCELLATION POLICY — define Renter cancellation windows and refund tiers, and Lender cancellation consequences. Recommend drafting before launch.]
12. Prohibited conduct
You agree not to: misrepresent items or yourself; transact off-platform to avoid fees; harass other Users; list items you do not own or may not rent/sell; or use the platform unlawfully. Violations may result in removal and account termination.
13. Disclaimers and limitation of liability
The platform is provided “as is.” Except as expressly stated, After I Do disclaims warranties to the fullest extent permitted by law. After I Do is not liable for the acts, omissions, items, or content of any User, or for any transaction between Users. [LIABILITY CAP AND CARVE-OUTS — attorney to set per governing-state law; see Attorney Brief §5.]
14. Indemnification
You agree to indemnify and hold harmless After I Do from claims arising out of your listings, your transactions, your items, or your breach of these Terms, to the extent permitted by law.
15. Dispute resolution
[DISPUTE RESOLUTION — arbitration agreement and/or class-action waiver, or court venue. Attorney to draft; see Attorney Brief §7.]
Disputes between Users over an item or transaction are between those Users. After I Do’s only role is administering the deposit and claim process in Sections 7–9.
16. Governing law
These Terms are governed by the laws of the State of [GOVERNING STATE], without regard to conflict-of-law rules. (See Attorney Brief §0 — depends on entity formation and the planned relocation.)
17. Changes to these Terms
We may update these Terms. Material changes will be posted with a revised “Last updated” date. Continued use after changes means you accept them.
